1. Definitions
- FelixFlows: the SaaS platform for forms, lead management, email sequences and website analytics, offered by VICS.
- User: any natural or legal person who creates an account and uses FelixFlows.
- Service: all features offered by FelixFlows, including but not limited to forms, lead management, analytics and email sequences.
2. Applicability
These terms and conditions apply to all use of FelixFlows. By creating an account or using the service, you agree to these terms.
3. Account
- You are responsible for keeping your login credentials confidential.
- You are responsible for all activities that occur under your account.
- You must provide accurate and up-to-date information when registering.
- We reserve the right to suspend or delete accounts in case of misuse or violation of these terms.
4. Use of the Service
You agree that you will not use FelixFlows for:
- Sending spam or unsolicited communications
- Collecting data in violation of GDPR or other privacy legislation
- Illegal activities or activities that infringe the rights of third parties
- Overloading or disrupting our systems
- Reverse engineering, copying or redistributing the software
5. Forms & Data Collection
As a user of FelixFlows, you are the data controller for the data you collect via forms. You are responsible for:
- Informing your visitors about what data you collect
- Complying with GDPR and other applicable privacy legislation
- Obtaining the correct consent from your visitors
FelixFlows acts as a data processor and processes the data exclusively on your behalf.
6. Email Sequences
When using the email sequence feature, you are yourself responsible for compliance with anti-spam legislation, including the Telecommunications Act. You must:
- Only send emails to persons who have given consent or with whom an existing relationship exists
- Provide a clear unsubscribe option
- Identify yourself as the sender
7. Analytics
The analytics feature of FelixFlows is designed with privacy in mind. We do not store IP addresses and do not use cookies for tracking. The analytics feature is currently in beta and may be subject to change.
8. Availability
We strive for the highest possible availability of the service, but do not guarantee 100% uptime. We are not liable for damages resulting from interruptions, failures or maintenance of the service.
9. Intellectual property
All intellectual property rights to the FelixFlows software, design and documentation belong to VICS. You only obtain a non-exclusive, non-transferable right of use for the duration of your subscription.
The data you enter and collect via FelixFlows remains your property.
10. Liability
- FelixFlows is provided "as is". We make no warranties as to fitness for a specific purpose.
- Our liability is limited to the amount you have paid to us in the 12 months preceding the damaging event.
- We are not liable for indirect damages, consequential damages or lost profits.
11. Termination
You can delete your account at any time. Upon termination, all your data will be permanently deleted within 30 days in accordance with our .privacy policy.
We reserve the right to terminate the service with a notice period of 30 days, giving you the opportunity to export your data.
12. Changes
We may change these terms from time to time. Changes will be published on this page. For significant changes, we will notify you at least 14 days in advance by email. Continued use after a change constitutes acceptance.
13. Applicable law
Dutch law applies to these terms. Disputes will be submitted to the competent court in the Netherlands.
